SUBMITTING A CONSUMER COMPLAINT
In accordance with Art. 6 item 3 of the Law on Provision of Services in Tourism (“Narodne novine” No. 130/17), the company informs consumers of their right to report disatisfaction with the service provided, in writing by e-mail to info@andadventure.com, whereby the company will, without delay, acknowledge the receipt of the complaint in writing.
Consumers can also send their objections by mail to Travel agency AKTIVNI ODMOR doo, J.Klovica 16B, 21000 Split
The company commits to respond in writing within 15 days of receipt of the writen complaint.
The complainant is obliged to indicate the first and last name and address for delivery of the reply.

TERMS AND CONDITIONS OF SALE
These Terms and Conditions define the ordering procedure, the payment process and the application of products and services offered through the website.
The website may be used for private purposes, free of charge, in accordance with the Terms and Conditions defined herein.
AndAdventure is the Provider and the person filling out the electronic order or e-mail inquiry and sending it to the provider via website and executing payment by credit card/debit card or bank transfer is the Customer. The commodity that is the object of the sale is one of the services offered on the website (trip, excursion, tour, cruise, accommodation).

ORDER PROCESS
The Customer orders the product or products by way of electronic order form or e-mail. Every person ordering at least one product, providing the requested information and sending the order via webpage or e-mail is considered a Customer.

1.Multi-day tours/ tailor made packages
Prices displayed on the website are of informative purpose.
All prices are expressed in EURO.
The price stated on the webpage includes the added value tax (VAT).
Multi-day tours/itineraries displayed on our website are for informational purpose. Final content of the package depends of the final choice of agreed services by client – tailor-made tours.
Final price of the package depends of services selected by the Client.
Travelers will receive all essential information about the package before concluding the package travel contract.
The Customer is under no obligation to pay additional costs for the realization of services ordered through this webpage.

2.Shared/Group day tours
All prices are final, expressed in EURO.
The price stated on the webpage includes the added value tax (VAT).
The Customer is under no obligation to pay additional costs for the realization of services ordered through this webpage.

3.The ordering process is conducted in the following manner:
3.1. The Customer selects the preferred itinerary suggestion on the website and sends e-mail inquiry or online order through website.
3.2. The Customer fills out the form for the selected service or sends e-mail, entering the information regarding the date and time of service start (trip, excursion, tour, cruise, accommodation), number of persons, possibly first and last names of these persons;
3.3. After recipiet of the e-mail or online order form, we process the inquiry and send reply to the Customer about the availability of the service, we agree on possible changes and services of clients interest (duration, type of the service, accommodation type). Before booking we provide the Customer with the final overview of all the information agreed before the final order confirmation;
3.4. The Customer confirms the order by entering the information regarding the payment card in the Flywire service for payment processing, or by sending bank transfer;
3.5.Flywire payment service authorizes and charges the payment card.
The service which is the object of the sale is considered ordered when the Customer selects it, confirms the manner of payment and successfully finalizes the credit, debit card authorization or bank transfer process.
Upon the finalization of the ordering process, the Customer is provided with the voucher that serves as confirmation of the purchase and the payment. The voucher contains the following information, which clearly define the ordered service and the clients: voucher number, service ordered, date of service use (departure date), possible time of service use (departure time), possible date and time of service expiration, price of the service, number of customers, possibly first and last names of customers, possible departure location.

3.6.The cancellation of the ordered service is regulated by the General Terms and Conditions.

PAYMENT
Ordered products or services are paid online, by means of one of the following credit and/or debit cards: MasterCard®, Maestro® or Visa®, American Express® through the Flywire service,  or by bank transfer. Flywire charges the Customer’s card upon the executed transaction.

SERVICE APPLICATION USE
The services contained in the order and stated on the voucher may be realized in the following manner:
The provided voucher serves as reservation and confirmation of the purchase, i.e. a ticket for the selected transfer, excursion, tour, cruise. The voucher may be used only once.
In the event that the voucher is lost, it shall be reissued at the request of the Customer, in accordance with the General Terms and Conditions. For this purpose, the Customer shall contact AndAdventure with the request to reissue the voucher.

CONVERSION STATEMENT
1.1. The credit card is charged by Flywire in your local currency. The amount that the credit card is charged with is obtained by conversion of EURO into your local currency according to the exchange rate determined by Flywire. The amount that is charged on the Customer’s credit card shall be translated into the client’s national currency by the card company applying the valid foreign exchange list of the client’s county. Thus, minor deviations from the EURO prices stated on our website are possible.

1.2. Bank Transfer – can be made in Euros and US Dollars, based on the conversion rate on the date of payment.

STATEMENT OF SECURITY
1. Flywire – Secure payments processing on this website is provided by Flywire. Online payments are communicated through a 256-bit SSL connection to Flywire and TLS 1.2 encryption towards the financial institutions. We are following the industry security standards such as PCI-DSS and ISO27001 while dealing with sensitive customer data. The charged amount on your credit card account is converted into your local currency according to the exchange rate of credit card associations.

STATEMENT OF PERSONAL DATA PROTECTION
AndAdventure undertakes to protect the personal data of the Customers by collecting only the basic information about the Customers/Clients, which are necessary to fulfill our obligations; it informs the Customers about the manner in which the collected data is used, regularly provides the Customers with the option of choosing the use of their data, including the possibility to choose whether they wish their name to be removed from the list used for marketing campaigns or not. All Customer information is strictly preserved and is available only to those employees who require them to perform their jobs. All employees and business partners of AndAdventure are responsible for observing the principle of privacy protection.

GENERAL TERMS AND CONDITIONS

1. Introduction
1.1. These Terms and Conditions of booking and purchase of travel packages (hereinafter referred to as: Terms and Conditions) are an integral part of the Contract, concluded by and between AndAdventure (Aktivni Odmor doo, J.Klovica 16b, Split/Croatia, VAT nr: HR69885716463 (hereinafter referred to as: (the) Organizer) and the Customer /Client (hereinafter referred to as: (the) Traveler) contracting the tourist package. Terms and Conditions contain important information about which the Organizer is obliged to inform the Traveler according to the provisions of the Act on Provision of Tourist Services, and as such they shall form a constituent part of the Travel Agreement within the Travel Package.

1.2. Prior to engaging into the agreement, the Traveler is obligated to carefully read the content of these General Terms and Conditions and separately submitted standardized information for the Travel Agreements within the Travel Package prescribed by the appropriate supplements of the Act on Provision of Tourist Services. The information volume provided in these documents and the time necessary to read them through cannot be a foundation for the assumption that the Traveler could not have studied them thoroughly enough.

1.3. The Traveler shall be considered any person who wishes to enter into a Travel Agreement within the Travel Package or who is entitled to travel based on the concluded Agreement within the Travel Package. The person concluding the Travel Agreement within the Travel Package assumes the responsibility to inform all the persons, who based on the Agreement are entitled to travel, about their rights and obligations arising out of the provisions of the Travel Agreement within the Travel Package as well as with any and all additional information, which shall be made available in personal contact with the Organizer’s representatives or via e-mail.

1.4. These General Terms and Conditions apply as of 09th of January 2023, and the Traveler shall be adequately warned about the application of these prior to conclusion of the Travel Agreement within the Travel Package. The provisions of the General Terms and Conditions, effective on the day of the Agreement conclusion, shall apply to all and any Travel Packages, for which Travel Agreements have been concluded prior to the application of these General Terms and Conditions.

1.5. In case of dispute that cannot be resolved amicably or by alternative consumer dispute mechanisms, the applicable law and jurisdiction according to headquarters of the Organizer shall prevail.

1.6. Terms used in this document which have a gender meaning shall refer equally to male and female gender.

2. Booking, Contracting, Travel Documents and Personal Travel Documents
2.1. All pre-contractual information, with which the Organizer has introduced the Traveler to, is constituent part of the Travel Agreement within the Travel Package, but the Organizer may modify it before concluding the Agreement so as to provide the Traveler any changes to the pre-contractual information in a clear, understandable and easily visible manner.

2.2. The Traveler who arranges the travel within a Tour Package guarantees that she/he is authorized by the travelers using the service of the Travel Package to provide the Organizer with their documents, personal information, and other necessary information, and that he is authorized to enter into the Travel Agreement within the Travel Package on their behalf.

2.3. The Travel Agreement within the Travel Package is considered binding after it has been signed by the contracting parties if it has been provided in writing to the Traveler, i.e. after the Traveler arranging the travel has provided all necessary traveler’s information and has clearly confirmed his agreement with the agreement information provided via e-mail, interfaces for online sale of travel packages, fax machines or other means of remote communication. If, after receiving contractual information and providing all necessary agreement information, the Traveler, who is arranging the travel, shall make available to the Organizer a credit card number for the payment of the travel package or shall conduct a payment to the Organizer’s bank account, the Agreement shall be considered as concluded without the other express statement from the Traveler.

2.4. The Traveler may book the trip organized by the Organizer, by e-mail, online order form, by telephone, or other means of remote communication, or with other authorized agents. By filling the credit card details using Flywire or sending a bank transfer, the Traveler fully accepts these Terms and Conditions upon having studied them carefully. 

2.5.During the booking, and for the purpose of booking confirmation of the selected service, the Traveler pays 50% of the package price (per person) to confirm the trip, unless explicitly stated otherwise in the pre-contractual information. The balance to the full price of the package is to be paid no later than 60 days before the start of the trip, unless explicitly stated otherwise in the pre-contractual information. 

2.6. The Organizer reserves the right, prior to the start of the package arrangement, to unilaterally modify the other terms of the Travel Agreement within the Travel Package in the case of a minor change that does not affect the main features of the trip so as to reduce the quality or value of the travel services or cause significant inconvenience or additional inconvenience to the Traveler’s expenses. The Organizer shall e-mail the Traveler with an appropriate notification of any changes that are considered insignificant.

2.7. If the Organizer must substantially change any of the essential features of the travel services before commencing the Travel Package or shall be unable to meet the agreed specific Traveler’s requirements specified in the Agreement, she/he shall provide the Traveler with an appropriate notice to the e-mail address. This notification shall include information about proposed changes, their impact on the package price and any replacement travel package, the time limit within which the Traveler must inform the Organizer of the acceptance or rejection of the proposed change or the replacement Travel Package, as well as the consequences in case the Traveler does not respond in a set deadline or reject the proposed changes.

2.8. The Organizer may terminate the Travel Agreement within the Travel Package prior to the start of the Travel Package and fully refund to the Traveler all payments received for the Travel Package, without any obligation to compensate the Traveler, if exceptional circumstances which could not have been avoided prevent the Organizer in fulfilling the Agreement. In the event of these circumstances, the Organizer shall notify the Traveler via e-mail of the termination of the Agreement without undue delay before the commencement of the package.

2.9. The Traveler shall be provided with all travel documents by e-mail no later than 5 (five) days prior to departure, unless stated otherwise in the program or as part of pre-contractual information. The travel documents shall include the following: the original voucher and written notices, if any, the tour program and emergency contact (phone number and e-mail).

2.10. The Travelers must have valid personal travel documents. Invalid documents leading to the cancellation of the travel shall not result in any harmful consequences for the Organizer, and, if the Organizer should suffer additional damages due to such an omission by the Traveler, the Traveler must compensate the damages suffered. 
If a travel document should be lost or stolen during travel, the costs of issuing new documents shall be borne by the Traveler. The Organizer’s guide shall assist the Traveler in such situation, taking care of the normal course of the program thereby. 

2.11. If a certain travel requires a visa, the Organizer may assist in obtaining such visa at a special additional fee. 

2.12. The Organizer shall not be held responsible for decisions by customs or police or other state authorities banning the Traveler’s entry into a particular country.

3. Package Contents, Price and Cancellation Policy
3.1.a. As a rule, (unless stipulated otherwise in the tour program) the LAND package price shall include: 
– transport services
– hotel and catering services
– agreed selection of activities/day tours/city guides
– VAT

3.1.b. As a rule, (unless stipulated otherwise in the tour program) the Sailing/Cruising package price shall include: 
– accommodation on a vessel
– crew (min 1 crew member) 
– fuel and final cleaning unless agreed otherwise in pre-contractual information and/or Package contents
– VAT and sojourn tax

3.2.a. The Land package price does not include (unless agreed otherwise):
– optional (elective) excursions and visits
– costs of obtaining and issuing visas, if any
– travel insurance
– meals if not indicated as included in the itinerary/ program

3.2.b. The Sailing/Cruising package price does not include (unless agreed otherwise):
– optional (elective) excursions and visits
– costs of obtaining and issuing visas, if any
– travel insurance
– meals if not indicated as included in the itinerary/ program and/or pre-contractual information
– mooring fees

3.2.c. Tour prices do not include the insurance from the risk of accident and illness while travelling, nor do they include the insurance from the risk of damage and loss of baggage or voluntary health insurance. By signing the tour Contract, with these Terms and Conditions as its integral part, it is understood that additional insurances have been offered and recommended to the Travelers. We recommend that you purchase travel insurance, prior to the tour.

3.3. All types of special services (single bedroom, special diet, etc.) shall be paid by the Traveler and must be ordered during booking process. If the Traveler asks for a special service during the tour, it shall be paid for it directly to the guide or the Agency representative, in the currency of the respective country.

3.4. Prices of all packages are based on the exchange rate of the Euro and foreign currencies. 

3.5. The Organizer reserves the right to increase the price of the Travel Package up to 8% of the agreed total price of the Travel Package in case the following occurred after the contract was entered into: 
– A change of exchange rates in relation to the program publication date
– A change of transport costs (fuel, road toll, etc.)
– A change in fees of hotels or carriers
– A change in Tax

3.6. If there is a need for an increase in the price of the Travel Package, the Organizer shall, no later than 20 (twenty) days before the start of the Travel Package, send to the Traveler’s e-mail the appropriate notice of the price increase with the explanation and calculation of the increase. The agreed price may not be increased in the period of twenty days prior to the start of the tour.

3.7. Should the pre-contractual information provide information on the possibilities and the method of calculating the change in the package price in the event of a price reduction, the Organizer shall refund the difference to the Traveler, decreased the administrative costs of calculation of a certified court expert. Should the administrative cost of calculating the difference is greater than the amount that the Organizer would have to repay, the Traveler is obliged to cover the difference incurred at his own expense. The Organizer will inform the Traveler about the estimated cost of the calculation.

3.8. If the price increase should exceed 8% of the agreed price, the Traveler may cancel the tour free of charge no later than 48 hours of receiving a written notice. If the Traveler should fail to cancel the tour within the stated term either personally at the Organizer point-of-sale or in writing, it shall be deemed that they agree to the price change. The Traveler undertakes to accept the price increase of up to 8%. The published prices are the result of contracts the Organizer has with its partners and may not correspond to the prices stated on the location, at the destination of the Traveler’s stay.

3.9. If the Traveler should cancel the booking, the Organizer shall keep the following amounts from the full package price unless otherwise explicitly stated in the pre-contractual information.
3.9.a. Land programs
– up to 60 days prior to departure, 25% of the package price, and no less than EUR 300.00
– 59 to 45 days prior to departure, 50% of the package price
– 44 to 0 days prior to the departure, 100% of the package price
– after the departure, 100% of the package price

3.9.b. In case of travel packages that include boat charter, T&C for boat charter will be applied, unless otherwise explicitly stated in the pre-contractual information.
– to 60 days prior to departure, 50% of the package price
– 59 to 0 days prior to the departure, 100% of the package price
– after the departure, 100% of the package price

3.9.c Cancellation of day trips:It is possible to cancel the booking without penalties up to 15days before the trip.

– For cancellations made 14-8 days and less before the trip, 30% amount will be charged.
– For cancellations made 7days and less before the trip, the full amount will be charged.

– Delays in scheduled departure: The maximum waiting time before the tour is canceled with full charge is 30 minutes in case we cannot reach clients at the hotel, at the agreed meeting point, or via the phone number we have in our records.
– Delays in scheduled departure if the tour includes transfer: The maximum waiting time before the tour is canceled with a full charge is 10 minutes in case we cannot reach clients at the hotel, at the agreed meeting point, or via the phone number we have in our records.
– If we need to cancel the tour due to weather conditions or other unforeseen situations, we will refund the paid amount for the trip.
We do not refund bank and credit card fees.
– The trip might be canceled and refunded due to weather, only if our head guides make a decision that the conditions do not meet the requirement to run the trip safely.

3.10. The Organizer may terminate the Travel Agreement within the Travel Package prior to the start of the Travel Package and fully refund to the Traveler all payments received for the Travel Package, without any obligation to compensate the Traveler, if exceptional circumstances which could not have been avoided prevent the Organizer in fulfilling the Agreement. In the event of these circumstances, the Organizer shall notify the Traveler via e-mail of the termination of the Agreement without undue delay before the commencement of the package.

3.11. For each trip in the Travel Package organized for groups, the Organizer shall indicate in the pre-contractual information the minimum number of persons required to organize the Travel Package. If this number is not reached, the Organizer reserves the right to terminate the Travel Agreement within the Travel Package before the start of the Travel Package, and shall inform the Traveler no later than twenty days before the start of the Travel Package for trips lasting more than six days; no latter then seven days before the start of the Travel Packages for trips that last between two and six days; 48 hours before the start of packages for trips that last less than two days; and 6 hours for day trips.

3.12. The Traveler can cancel the booking before the start of the Travel Package without paying any fee for termination of the Agreement in the event of unavoidable circumstances that occurred at or near the destination and which significantly affect fulfillment of Travel Packages or which significantly affect the transportation of the travelers to their destination, unless otherwise explicitly stated in the pre-contractual information.
In assessing the level of impact of extraordinary circumstances on the fulfillment of the Travel Packages or transportation of the travelers to the destination, the assessments of the competent public authorities in the tourist destination and of the carrier shall be taken into account.

3.13. The stated costs of cancellation shall also apply to changes of the departure date or the type of the accommodation facility, i.e. the type of the room/apartment, and to all other major changes. A cancellation scale that may differ from the stated one is included in a specific program and pre-contractual information to which it refers. If the Traveler cancelling the tour finds a new beneficiary of the same booking, who meets the anticipated requirements, the Organizer shall charge the costs caused by the replacement. If all packages should be cancelled, the costs for obtaining visa/s or travel documents are not refunded. If the Traveler cancels the tour or shortens the travel due to bad weather conditions, the Organizer shall apply the above-mentioned scale and subsequent complaints shall not be acknowledged.

3.14. The Organizer reserves the right to change the date or the time of the departure due to a change in the ferry or other included public transportation schedule or the onset of unanticipated circumstances, as well as the right to change the itinerary if there should be a change in travel conditions such as: the changed included public transportation schedule, safety conditions in a country, (unfavorable) weather conditions without compensating the damages, and according to the current regulations in the international traffic. If the tour is cancelled by the Organizer, the Traveler shall be entitled to the full refund of the amount paid, not including the compensation of damages.

3.15. The Organizer holds the right to exclude from the tour any person, if they find that the person is not capable for participating safely in the tour, or if they evaluate that the person might harm the safety of the tour or other members on the tour. In such case no refund or compensation of damage will be made to the excluded individual(s).

3.16. The Cost of Booking per Request and the Cost of Booking Change
The Organizer does not charge reservation fee.
The Travelers may transfer the package to another person, on reasonable notice and is subject to additional costs and 50 euro administrational fee.

3.17. Discounts for Children and Other Benefits
Please, pay attention to discounts for children and other benefits which are specified in the package description and/or as part of pre-contractual information.

4.Organizer’s Obligations
4.1.The performance of the travel services included in this Travel Agreement for Travel Package are sole responsibility of the Organizer, regardless of the fact if he has to provide these services himself or other service providers provide them on his behalf.

4.2. The Organizer undertakes to provide the Traveler with all the contracted services for a particular package, and to provide answers in case of possible failure to perform services or a part of services. If any of the travel services shall not be provided in accordance with the Travel Agreement within the Travel Package, the Organizer shall upon the Traveler’s request correct this discrepancy, unless it is impossible or such correction of the discrepancy would cause disproportionate costs considering the discrepancy and the travel service value, which the discrepancy affects.

4.3. The Organizer shall fulfill all the obligations stated in its programs fully and as described, except in the event of Force Majeure or changed circumstances. In such cases, the Organizer shall offer a substitute solution if possible. 

4.4 Should the Organizer fail to correct the discrepancy due to reasons stated in the item 4.2. of these General Terms and Conditions, the Traveler shall be entitled to the price reduction and damage compensation according to the provisions of the General Terms and Conditions regulating the right to price reduction and damage compensation.

4.5. If, after the start of the package, significant elements of the package cannot be provided as agreed, suitable alternative arrangements will have to be offered to the Traveler at no extra cost. The Traveler may terminate the contract without paying any termination fee, where services are not performed in accordance with the contract and this substantially affects the performance of the package and the Organizer fails to remedy the problem.

4.6. The Traveler is also entitled to a price reduction and/or compensation for damages where the travel services are not performed or are improperly performed.

4.7. Should the Organizer suggest an alternative Travel Package of a lower quality than the one stated in the Travel Agreement within the Travel Package, the Organizer shall suggest an appropriate price reduction.

4.8. The Traveler is entitled to an appropriate price reduction for every time period, during which a discrepancy regarding the travel agreed within the Travel Package, unless the Organizer shall prove that the discrepancy emerged due to the Traveler.

4.9. Regardless the price reduction or the agreement termination, the Traveler is entitled to demand from the Organizer an appropriate damage compensation for every damage he endures as a result of any and discrepancies, and the Organizer shall compensate such damage without further delay.

4.10. The Organizer shall not be held responsible for the damage, should he prove that the discrepancies have been caused by the Traveler or that the discrepancies have been caused by a third party who is not related to the providing of the travel services included in this Travel Agreement within the Travel Package, and that the discrepancy is unforeseeable or unavoidable or that the discrepancy was caused by extraordinary circumstances that could not have been avoided.

4.11. The Organizer shall limit in advance the compensation amount for the damages which have not been a consequence of the bodily injuries or for the damages which have not been caused by the Organizer on purpose or by negligence to the amount of the triple total price of the Travel Package.

4.12. If the international conventions binding on the European Union or the regulations based thereon limit the scope of compensation for damage paid by the travel service provider which forms part of the Travel Package or limit the conditions under which he is obliged to compensate for such damage, in which case assumptions, restrictions and exclusions apply appropriately to the Organizer, he may refer to this fact in relation to the Traveler.

4.13. The Traveler’s right to compensation or price reduction prescribed by the Act on the Provision of Tourist Services and international conventions shall not affect the Traveler’s rights in accordance with the Regulation (EC) No. 261/2004 of the European Parliament and of the Council of 11th February 2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, and repealing Regulation (EEC) No 295/91; Regulation (EC) No 1371/2007 of the European Parliament and of the Council of 23rd October 2007 on rail passengers’ rights and obligations; Regulation (EC) No. 392/2009 of the European Parliament and of the Council of 23rd April 2009 on the liability of carriers of passengers by sea in the event of accidents; Regulation (EU) No 1177/2010 of the European Parliament and of the Council of 24th November 2010 concerning the rights of passengers when travelling by sea and inland waterway and amending Regulation (EC) No 2006/2004; Regulation (EU) No 181/2011 of the European Parliament and of the Council of 16th February 2011 concerning the rights of passengers in bus and coach transport and amending Regulation (EC) No 2006/2004.

4.14. The Traveler is entitled to submit claims for price reduction and/or compensation in accordance with the Act on the Provision of Tourist Services as well as in accordance with the international conventions and regulations referred to in the preceding paragraph of these General Terms and Conditions.

4.15. Damage compensations or price reductions to which the Traveler is entitled under the Act on the Provision of Tourist Services and in accordance with the international conventions and regulations referred to in the Item 4.13. of these General Terms and Conditions shall be deducted from each other in order to avoid excessive compensation and / or excessive price reduction.

4.16. The Traveler’s right to request a price reduction pursuant to the provisions of the Act on the Provision of Tourist Services, which regulate the issues of modification of the Travel Agreement within a Travel Package prior to the commencement of the Travel Package, the execution of the Travel Package, and the reduction of the price and compensation of damages shall become obsolete within two years. The statute of limitations begins as of the first day after the day on which the Travel Package under the Agreement should have ended.

4.17. The Organizer shall provide appropriate assistance without undue delay to the Traveler in distress, especially under circumstances where, due to exceptional circumstances that could not have been avoided, it was not possible to ensure the return of the Traveler in accordance with the Travel Agreement within a Travel Package. This assistance relates in particular to providing adequate information on health services, local authorities and consular assistance as well as assisting the Traveler in establishing remote communication and in finding alternative travel arrangements.

4.18. Should the Traveler have caused a problem intentionally or by negligence, the Organizer shall charge for the assistance from the preceding Item of these General Terms and Conditions, which will not exceed the actual costs of the Organizer.

4.19. The Organizer is not obliged to provide services beyond these Terms and Conditions. 

4.20. The Organizer is not responsible for possible print errors.

5. Traveler’s Obligations
5.1. The Traveler undertakes to personally meet the conditions anticipated by the regulations of the Republic of Croatia and the country through which or to which they travel, and to observe the house rules in hotel and other facilities, to cooperate with the representative of the Organizer and with service providers. 

5.2. The Traveler is obliged to meet all the requirements of the country of destination in relation to the passports and visas and health formalities indicated in the pre-contractual information on time before the journey, and to carry with him all the relevant travel documents, including appropriate certificates of completion of the health formalities, during the trip, and to make these available to the competent officials.

5.3. The Traveler is personally responsible for any damages caused, particularly for the damages that are the result of failure to observe the contract and these General Terms and Conditions. 

5.4. The Traveler shall cover the incurred damages immediately at the hotel reception desk, vessel and at another place stipulated by the physical or legal entity who suffered the damages.

5.5. If package includes adventurous and sports activities, the Traveler is obliged to deliver information to the Organizer, about the fitness level and any known medical issues.

5.6. Without any unnecessary delay and considering the circumstances, the Traveler shall be obligated to inform the Organizer of any and all discrepancies, he shall determine during the fulfillment of the travel services included in Travel Agreement within the Travel Package.

6. Categorization and Service Description
6.1. Accommodation facilities offered in the Organizer’s programs are described according to the official categorization of the respective country, valid at the moment of the program publication. Diet, modern conveniences and all other services offered by hotels/apartments are supervised by local tourist boards, while the standards of accommodation and services differ and are not comparable. The Organizer assumes no responsibility for any verbal or written information differing from the description of services and facilities in the published programs obtained from a third party.
Rooms/apartments are distributed by the reception desk at the place of staying. Unless the Traveler has explicitly booked a specific room/apartment they shall accept any officially registered accommodation unit for rent in the specific facility described in the catalogue and the price list. Accommodation in the room/apartment is usually not possible before 4.00 p.m. on the service start date, and the Traveler usually must leave the rooms/apartments by 10.00 a.m. on the service end date. Arrivals after 8.00 p.m. must be advised in advance, unless otherwise indicated. Pets are allowed in particular cases with an obligatory additional fee.

6.2. The Organizer shall use the means of transport of the carriers, which have the appropriate licenses in accordance with the special regulations that regulate each type of transport, for the performance of transport services under the Travel Package. Unless otherwise explicitly stated in the pre-contractual information, the Organizer shall use means of transport in which the passenger cabins are air-conditioned and with a loudspeaker, and seats with tilting and at least one armrest. For bus transportation, unless explicitly stated otherwise in the pre-contractual information, the Organizer retains the possibility of using minibuses, low-floor, high-floor and double-deckers, with part of the seat facing away from the direction of travel.

6.3. Unless otherwise stated in the pre-contractual information, the tourist services covered by the Travel Package are generally not suitable for persons with reduced mobility. At the request of the Traveler, the Organizer will also provide more accurate information about the suitability of the trip or holiday taking into account the needs of the Travelers.

7. Foreign Exchange and Customs Regulations
The Travelers must comply with all foreign exchange and customs regulations, laws and other by-laws of the Republic of Croatia and other countries through which they travel and where they stay.
If the tour cannot be continued because the Traveler has violated the regulations, all incurred costs shall be borne solely by the person having violated the regulations.

8. Health Regulations
Travel to some countries is conditioned by mandatory vaccination against specific diseases. When travelling to such countries, the Traveler must hold certificates and documents of vaccinations.

9. Baggage
The Traveler must take care of their belongings brought on the vehicle and are obliged to bring them along whenever leaving the bus. Otherwise, the Traveler shall be responsible for theft, loss or damage of objects left unattended in the bus.

10. Complaints
10.1. Pursuant to the provisions of the Act on the Provision of Tourist Services, the Traveler is entitled to submit written objections by mail to the address Aktivni Odmor d.o.o., turistička agencija, J.klovica 16B, 21000 Split, or to the e-mail info@andadventure.com The Organizer shall confirm the receipt of the written complaint without delay, and reply in writing to the complaint within 15 days as of the receipt of the complaint.

10.2. Pursuant to a special act on the alternative consumer dispute resolution, the available mechanisms for alternative consumer dispute resolution include the possibility of initiating an alternative consumer dispute resolution procedure with an authorized body for alternative consumer dispute resolution, which is also covered by the Organizer through the online consumer dispute resolution platform for services purchased online.

10.3. The authorized body for the alternative consumer dispute resolution, under which jurisdiction the Organizer falls, is Centar za mirenje pri Hrvatskoj gospodarskoj komori (Dispute Resolution Center with the Croatian Chamber of Commerce), Rooseveltov trg 2, 10000 Zagreb, https://www.hgk.hr/centar-za-mirenje/o-mirenju

10.4. For services purchased online, the Traveler may submit his complaint to the authorized body for the alternative consumer dispute resolution by using the online consumer dispute resolution platform available at the following website address: https://ec.europa.eu/consumers/odr/main/?event=main.home2.show

11. Warranty in case of insolvency or bankruptcy of the tour organizer
Pursuant to the Tourism Act, in case of insolvency or bankruptcy of the Organizer, the Travelers caught by it while travelling, as well as persons who made down payments for a travel should contact the provider stated on the travel certificate or on another corresponding document as soon as possible. 12. Personal Data Protection
The Traveler provides personal data voluntarily. Personal data of the Traveler are necessary in the process of realization of the requested service. These shall also be used for further mutual communication.
The Organizer undertakes not to export the Traveler’s personal data abroad, or provide any third persons with such information, except for the purposes of realization of the requested service.
The exception to providing third persons with the Traveler’s personal data regards the contracting of insurance for the risk of cancellation, insurance from consequences of accident and illness, insurance from risk of damage and loss of baggage and voluntary health insurance of persons during travelling and staying abroad. If the Traveler should take out an insurance policy, personal data shall be forwarded to the insurance company.
The Traveler’s personal data shall be kept in a database, pursuant to the Decision of the Administration regarding the manner of collecting, processing and keeping personal data.
The Travelers allow their personal data to be used for the purposes of the Organizer’s marketing activities.

13. Final Provisions
These Terms and Conditions are an integral part of the Contract that the Traveler enters into with the Organizer, i.e. an authorized travel agency where they booked the trip organized by the Organizer. Possible/anticipated deviations from these Terms and Conditions must be stated with the text of the tour program and/or pre-contractual information if dealing with tour operators – international travel organizers. By signing the contract, the Traveler fully accepts the program and these Terms and Conditions. The issue of these Terms and Conditions makes all previous versions null and void.

UVJETI PRODAJE
Ovim se uvjetima utvrđuje postupak naručivanja, plaćanja te preuzimanja proizvoda i usluga ponuđenih na web stranicama.
Internet stranice mogu se koristiti za vašu privatnu upotrebu bez ikakvih naknada za korištenje, a prema sljedećim uvjetima i pravilima.
Prodavatelj je Aktivni Odmor d.o.o., a kupac je posjetitelj ovih stranica koji popuni elektronsku narudžbu, pošalje je prodavatelju putem web stranica ili e-mailom, te izvrši plaćanje putem kreditne/debitne kartice ili bankovnim transferom. Roba, predmet prodaje, je jedna od usluga iz ponude na stranicama (transfer, izlet, paket-aranžman).

NARUČIVANJE
Kupac naručuje proizvod ili proizvode putem E-maila i/ili elektronskog obrasca narudžbe. Kupcem se smatra svaka osoba koja elektronski naruči barem jedan proizvod, popuni tražene podatke i pošalje narudžbu putem web stranica ili e-mailom.
Višednevne ture/Paket aranžmani skrojeni prema želji klijenta
Cijene na web stranicama su informativne. Cijene su iskazane u EUR. U cijeni iskazanoj na web stranicama sadržan je porez na dodanu vrijednost (PDV).

Prijedlozi višednevnih itinerara, višednevnih tura i sadržaja paket aranžmana su informativne naravi. Konačni sadržaj ture/ paket-aranžmana ovisi o uslugama odabranim od strane klijenta (krojeni aranžmani).

Prije sklapanja Ugovora, Kupac će dobiti sve bitne informacije o dogovorenom paket-aranžmanu.

Dnevni izleti
Sve cijene su konačne, iskazane u EUR. U cijeni iskazanoj na web stranicama sadržan je porez na dodanu vrijednost (PDV).
Za realizaciju usluga koje Kupac naruči putem ovih web stranica, Kupac nema obavezu plaćanja nikakvih dodatnih troškova.
Prije prihvaćanja ponude, Kupac će dobiti sve bitne informacije o dogovorenom izletu.

Proces naručivanja
1. Kupac odabire prijedlog itinerara na web stranicama i šalje upit e-mailom ili putem online obrasca;
2. Za odabranu uslugu, na obrascu za naručivanje ili u e-mailu unosi podatke o datumu i vremenu početka usluge, broju osoba, eventualno imenima i prezimenima osoba;
3. Po primitku obrasca ili e-maila šaljemo povratnu informaciju klijentu sa potvrdom raspoloživosti usluge, dogovaramo eventualne izmjene (trajanje, vrsta usluga, tip smještaja) i kupcu još jednom šaljemo sve detaljne podatke o dogovorenom sadržaju usluge/ paket-aranžmana prije konačne potvrde narudžbe;
4. Kupac potvrđuje narudžbu i na Flywire servisu za procesiranje platnih transakcija unosi podatke o platnoj kartici ili uplaćuje potvrdu rezervacije bankovnim nalogom.
5. Flywire servis autorizira platnu karticu.

Usluga koja je predmet prodaje se smatra naručenom u trenutku kada kupac odabere i potvrdi način plaćanja, te kada se uspješno završi proces autorizacije kreditne i/ili debitne kartice kojom plaća ili zaprimi uplata putem bankovne transakcije.
Po završetku procesa naručivanja kupac dobiva vaučer koji služi kao potvrda kupovine i plaćanja. Vaučer sadrži sljedeće podatke koji nedvosmisleno definiraju naručenu uslugu i korisnike usluge: broj vaučera, naručena usluga, datum korištenja usluge (datum polaska), eventualno vrijeme korištenja usluge (vrijeme polaska), eventualno datum i vrijeme završetka usluge, cijena usluge, broj korisnika, eventualno imena i prezimena korisnika, eventualno mjesto polaska.
Otkaz naručene usluge reguliran je općim uvjetima poslovanja.

PLAĆANJE
Naručeni proizvodi ili usluge plaćaju se online jednom od kreditnih i/ili debitnih kartica ili nalogom banci. Plaćanje kreditnim i/ili debitnim karticama MasterCard®, Maestro® ili Visa®, American Express®, se vrši putem Flywire servisa. Flywire tereti karticu kupca po uspješno izvršenoj transakciji. Po izvršenoj uplati, kupcu se račun o uplaćenom predujmu šalje e-mailom.

PREUZIMANJE, KORIŠTENJE USLUGE
Usluge sadržane u narudžbi i navedene na vaučeru mogu se realizirati na sljedeći način:
Dostavljeni vaučer služi kao rezervacija i potvrda kupnje odnosno ulaznica za odabrani transfer, izlet, turu, krstarenje. Kupac vaučer predaje zastupniku agencije po dolasku na ukrcajno mjesto za transfer, izlet, turu, krstarenje. Vaučer se može iskoristiti samo jedan put.
Ponovno izdavanje vaučera u slučaju eventualnog gubitka, vrši se sukladno općim uvjetima poslovanja na zahtjev kupca. U tom smislu kupac kontaktira AndAdventure sa zahtjevom za ponovno izdavanje vaučera.

IZJAVA O KONVERZIJI
Naplata po kreditnoj kartici vrši se u Eurima. Iznos u Eurima za koji će biti terećena vaša kreditna kartica dobiva se konverzijom EUR-a u valutu kupca prema tečaju utvrđenom od strane Flywire. Iznos terećenja kreditne kartice u EUR vaš kartičar preračunava u vašu domicilnu valutu primjenom tečajne liste važeće u vašoj zemlji. Sukladno tome, moguća su minimalna odstupanja od cijene u EUR-ima istaknute na našoj web stranici.

IZJAVA O SIGURNOSTI
Flywire je siguran sustav za online plaćanje, plaćanje u realnom vremenu, kreditnim i debitnim karticama te drugim načinima plaćanja. Flywire kupcu i trgovcu osiguravaju siguran upis i prijenos upisanih podataka o karticama što podvrđuje i PCI DSS certifikat koji WSPay ima. WSPay koristi SSL certifikat 256 bitne enkripcije te TLS 1.2 kriptografski protokol kao najviše stupnjeve zaštite kod upisa i prijenosa podataka.

IZJAVA O ZAŠTITI OSOBNIH PODATKA
AndAdventure se obavezuje pružati zaštitu osobnih podataka kupaca, na način da prikuplja samo nužne, osnovne podatke o kupcima/korisnicima koji su nužni za ispunjenje naših obveza; informira kupce o načinu korištenja prikupljenih podataka, redovito daje kupcima mogućnost izbora o upotrebi njihovih podataka, uključujući mogućnost odluke žele li ili ne da se njihovo ime ukloni s lista koje se koriste za marketinške kampanje. Svi se podaci o korisnicima strogo čuvaju i dostupni su samo djelatnicima kojima su ti podaci nužni za obavljanje posla. Svi djelatnici AndAdventur-a i poslovni partneri odgovorni su za poštivanje načela zaštite privatnosti.

OPĆI UVJETI POSLOVANJA

1.Uvodna napomena
1.1 Ove Upute i uvjeti rezervacije i kupnje turističkih aranžmana (u daljnjem tekstu Upute i uvjeti) sastavni su dio Ugovora odnosno vaučera koji su sklopljeni između AndAdventure-a – Aktivni Odmor doo, J.Klovica 16b, Split/Croatia, VAT nr: HR69885716463 (u daljnjem tekstu Organizator) i putnika/ugovaratelja turističkog aranžmana (u daljnjem tekstu Putnik) koji se prijavljuje za turistički aranžman. Ovi opći uvjeti sadrže važne informacije s kojima je Organizator dužan upoznati putnika sukladno odredbama Zakona o pružanju usluga u turizmu i kao takve čine sastavni dio ugovora o putovanju u paket-aranžmanu.

1.2. Putnik je dužan, prije nego se na bilo koji način obveže ugovorom, pozorno proučiti sadržaj ovih Općih uvjeta i zasebno uručenih standardnih informacija za ugovore o putovanju u paket-aranžmanu propisanih odgovarajućim prilozima Zakona o pružanju usluga u turizmu. Opseg informacija u ovim dokumentima i vrijeme potrebno za upoznavanje s njima ne može biti osnova tvrdnje da ih putnik nije mogao primjereno proučiti.

1.3. Putnik je svaka osoba koja želi sklopiti ugovor o putovanju u paket-aranžmanu ili koja ima pravo putovati na temelju sklopljenog ugovora o paket-aranžmanu. Osoba koja sklapa ugovor o putovanju u paket-aranžmanu preuzima obvezu upoznati sve osobe koje na temelju sklopljenog ugovora imaju pravo putovati s pravima i obvezama koje proizlaze iz odredaba ugovora o putovanju u paket-aranžmanu te sa svim dodatnim informacijama koje dobiva u osobnom kontaktu s predstavnicima organizatora ili putem e-pošte.

1.4 Ovi opći uvjeti primjenjuju se od 9. 1. 2023. godine i o njihovoj primjeni putnici će biti primjereno upozoreni prije sklapanja ugovora o putovanju u paket-aranžmanu. Na sve paket-aranžmane za koje su sklopljeni ugovori o putovanju u paket-aranžmanu prije početka primjene ovih općih uvjeta važeće su odredbe općih uvjeta koji su bili u primjeni u trenutku sklapanja ugovora.

1.5 Za slučaj spora kojeg ne bi bilo moguće riješiti sporazumno ili putem mehanizama za alternativno rješavanje potrošačkih sporova uglavljuje se mjerodavnost prava i nadležnost suda prema sjedištu organizatora putovanja.

1.6 Izrazi koji se koriste u ovom dokumentu, a imaju rodno značenje odnose se jednako na muški i ženski rod.

2. Prijave, Ugovaranje, Putna dokumentacija i Putne isprave
2.1. Sve predugovorne informacije s kojima je Organizator upoznao Putnika čine sastavni dio ugovora o putovanju u paket-aranžmanu, ali ih organizator može izmijeniti prije sklapanja ugovora tako da dostavi putniku na jasan, razumljiv i lako uočljiv način sve izmjene predugovornih informacija.

2.2 Putnik koji ugovara putovanje u paket-aranžmanu jamči da je ovlašten od putnika koji koriste usluge paket-aranžmana dati organizatoru putovanja njihove dokumente, osobne podatke, i ostale potrebne informacije, da je u njihovo ime ovlašten sklopiti ugovor o putovanju u paket-aranžmanu.

2.3 Ugovor o putovanju u paket-aranžmanu smatra se obvezujućim nakon što su ga potpisale ugovorne strane ukoliko je Putniku dostavljen u pisanom obliku, odnosno nakon što je Putnik koji ugovara putovanje dostavio sve potrebne podatke o putnicima i jasno potvrdio svoju suglasnost s dostavljenim ugovornim informacijama putem e-pošte, sučelja za mrežnu prodaju paket-aranžmana, telefaksa ili nekog drugog sredstva za komunikaciju na daljinu. Ukoliko je Putnik koji ugovara putovanje, nakon što je primio ugovorne informacije i dostavio sve potrebne informacije o putnicima, stavio na raspolaganje organizatoru broj kreditne kartice u svrhu plaćanja aranžmana ili je izvršio uplatu na žiro-račun organizatora, smatrat će se da je ugovor sklopljen i bez druge izričite izjave Putnika.

2.4 Putnik se za putovanje koje organizira Organizator može prijaviti online obrascem sa web stranica, e-mailom, telefonom ili drugim sredstvima komunikacije na daljinu, te kod drugih ovlaštenih agenata. Putnik potvrđuje narudžbu kada na Flywire servisu za procesiranje platnih transakcija unosi podatke o platnoj kartici ili uplaćuje potvrdu rezervacije bankovnim nalogom kod kupnje usluga putem sredstava komunikacije na daljinu. Putnik u cijelosti prihvaća ove Upute i uvjete koje je prethodno pažljivo proučio. 

2.5. Prilikom prijave, a u svrhu rezervacije odabrane usluge, Putnik uplaćuje 50% cijene aranžmana (po osobi) ako u predugovornim informacijama izričito nije naznačeno drugačije. Razlika do pune cijene aranžmana uplaćuje se najkasnije 45 (četrdeset i pet) dana prije početka putovanja, ako u predugovornim informacijama izričito nije naznačeno drugačije.

2.6. Organizator putovanja zadržava pravo prije početka paket-aranžmana jednostrano izmijeniti i ostale uvjete ugovora o putovanju u paket-aranžmanu ukoliko se radi o beznačajnoj izmjeni koja ne utječe na glavne značajke putovanja tako da snižava kvalitetu ili vrijednost usluga putovanja ili da Putniku prouzroče znatne neugodnosti ili dodatne troškove. Organizator će na adresu e-pošte Putnika dostaviti odgovarajuću obavijest o izmjenama koje se smatraju beznačajnima.

2.7. Ukoliko Organizator putovanja prije početka paket-aranžmana mora znatno izmijeniti bilo koje od bitnih obilježja usluga putovanja ili ne može ispuniti ugovorene posebne zahtjeve Putnika navedene u ugovoru o tome će putniku na adresu e-pošte dostaviti odgovarajuću obavijest. Ta će obavijest obuhvaćati informacije o predloženim izmjenama, njihovom utjecaju na cijenu aranžmana i eventualnim zamjenskim paket-aranžmanima, o roku u kojem Putnik mora Organizatora obavijestiti o prihvaćanju ili odbijanju predložene izmjene odnosno zamjenskog paket-aranžmana kao i o posljedicama u slučaju da Putnik ne odgovori u zadanom roku ili odbije predložene izmjene.

2.8. Organizator može raskinuti ugovor o putovanju u paket-aranžmanu prije početka paket-aranžmana i Putniku u cijelosti vratiti sva plaćanja primljena za paket-aranžman, bez obveze naknade štete putniku, ako Organizatora u izvršenju ugovora spriječe izvanredne okolnosti koje se nisu mogle izbjeći. Ukoliko do tih okolnosti dođe, Organizator će Putnika putem e-pošte obavijestiti o raskidu ugovora bez nepotrebnog odgađanja prije početka paket-aranžmana.

2.9 Putniku će svi putni dokumenti biti dostavljeni u elektronskom obliku najkasnije 5 dana prije polaska na put, ukoliko u programu ili predugovornim informacijama nije drugačije navedeno. Putna dokumentacija podrazumijeva:
originalni vaučer, program putovanja i eventualne pismene obavijesti, te telefonski broj za hitne slučajeve, putem kojega mogu stupiti u kontakt s Organizatorom.

2.10 Putnici su obvezni posjedovati valjane osobne putne isprave. Nevaljane isprave, koje imaju za posljedicu odustajanje od putovanja, ne proizvode nikakve štetne posljedice za Organizatora, a ukoliko bi zbog takvog propusta Putnika Organizator pretrpio dodatnu štetu, Putnik je dužan istu nadoknaditi. Ukoliko za vrijeme putovanja dođe do gubitka ili krađe putnih isprava, troškove izdavanja novih isprava snosi sam Putnik.

2.11. Organizatorov pratitelj će pomoći Putniku u slučaju gore navedene situacije, ali vodeći pritom računa o normalnom odvijanju programa. Ako je za neko putovanje potrebna viza, Organizator može posredovati u pribavljanju iste uz posebnu doplatu.

2.12. Organizator nije odgovoran za odluke carinskih, policijskih i drugih državnih tijela kojima se Putniku ne dozvoljava ulazak u pojedinu zemlju.

3.Sadržaj aranžmana, Cijena i Odustajanje od putovanja 
3.1.a U cijenu aranžmana (ukoliko u programu putovanja i/ili predugovornim informacijama nije drugačije navedeno) u pravilu je uključeno sljedeće:
– usluge prijevoza,
– hotelske i ugostiteljske usluge,
– organizacija putovanja
– izbor dnevnih izleta/aktivnosti/stručnih vođenja – dogovorenih prije sklapanja Ugovora
– PDV

3.1.b. U cijenu aranžmana kružnih putovanja jedrilicama i ostalim plovilima u ponudi (ukoliko u programu putovanja i/ili predugovornim informacijama nije drugačije navedeno) u pravilu je uključeno sljedeće:
– usluga smještaja na plovilu
– gorivo i završno čišćenje – ukoliko nije drugačije navedeno u programu putovanja i/ili predugovornim informacijama
– posada (min 1.član)
– PDV i boravišna pristojba

3.2.a. U cijenu aranžmana nije uključeno sljedeće (osim ako nije drugačije dogovoreno i ukoliko u programu putovanja i/ili predugovornim informacijama nije drugačije navedeno):
– fakultativni (neobavezni) izleti i posjeti,
– mogući troškovi pribavljanja i izdavanja viza,
– putno osiguranje
– obroci ukoliko nije drugačije navedeno u programu putovanja i/ili predugovornim informacijama

3.2.b U cijenu aranžmana na plovilima nije uključeno sljedeće (osim ako nije drugačije dogovoreno i ukoliko u programu putovanja i/ili predugovornim informacijama nije drugačije navedeno):
– fakultativni (neobavezni) izleti i posjeti,
– mogući troškovi pribavljanja i izdavanja viza,
– putno osiguranje
– obroci ukoliko nije drugačije navedeno u programu putovanja i/ili predugovornim informacijama
– vezovi u lukama

3.2.c. Cijene putovanja ne uključuju osiguranje od rizika nesretnog slučaja i bolesti na putovanju, osiguranje od oštećenja i gubitka prtljage kao ni dragovoljno zdravstveno osiguranje.
Potpisivanjem ugovora o putovanju, čiji su sastavni dio i ove Upute i uvjeti, smatra se da su putnicima ponuđena i preporučena dodatna osiguranja navedena u prethodnom stavku.
U slučaju da Putnik zahtijeva navedena osiguranja, ona se mogu ugovoriti izravno kod jednoga od osiguravatelja. Preporučamo pozorno proučiti uvjete osiguranja prije ugovaranja polica osiguranja.

3.3. Sve vrste posebnih usluga (jednokrevetna soba, posebna prehrana i sl.) Putnik plaća dodatno i dužan ih je naručiti prilikom prijave putovanja. Ukoliko Putnik traži posebnu uslugu za vrijeme putovanja, plaća je na licu mjesta vodiču ili predstavniku Agencije.

3.4 Cijene svih aranžmana temeljene su na odnosu vrijednosti kune i stranih valuta. 

3.5. Organizator može zahtijevati povećanje ugovorene cijene ukoliko je nakon dana sklapanja ugovora, a u svakom slučaju najkasnije 20dana prije početka paket-aranžmana, došlo do:
– promjene valutnih tečajeva u odnosu na dan objavljivanja programa,
– promjena troškova prijevoza (goriva, cestarina i sl.),
– promjene tarifa hotelijera i prijevoznika.
– promjene poreznih stopa

3.6 Organizator može o promjeni cijene aranžmana izvijestiti pismeno ili usmeno.
Ukoliko dođe do potrebe povećanja cijene paket-aranžmana, Organizator će najkasnije 20 dana prije početka paket-aranžmana na adresu e-pošte Putnika dostaviti odgovarajuću obavijest o povećanju cijene uz obrazloženje i izračun povećanja.

3.7. Ukoliko su u predugovornim informacijama navedene informacije o mogućnostima i načinu izračuna promjene cijena paket-aranžmana u slučaju sniženja cijena, Organizator će putniku vratiti nastalu razliku u cijeni umanjenu za administrativne troškove izračuna ovlaštenog sudskog vještaka. Ukoliko su administrativni troškovi izračuna razlike veći od iznosa koji bi Organizator trebao vratiti, Putnik je dužan o svojem trošku podmiriti nastalu razliku. Organizator putovanja će o okvirnim troškovima izračuna prethodno obavijestiti Putnika.

3.8. Putnik može otkazati aranžman bez troška otkaza ako dođe do povišenja cijene više od 8% u odnosu na ugovorenu i to najkasnije u roku od 48 sati od primljene pismene obavijesti. Ne otkaže li Putnik aranžman pisanim putem u navedenom roku, smatra se da je suglasan s promjenom cijene. U slučaju otkaza putovanja zbog povećanja cijene većeg od 8%, Putnik nema pravo na naknadu štete.
Putnik se obvezuje prihvatiti povećanje cijene do 8%.
Objavljene cijene rezultat su ugovora Organizatora s partnerima i ne moraju odgovarati cijenama istaknutima na licu mjesta u odredištu u kojem Putnik boravi.

3.9. Odustajanje od putovanja
3.9.a. Ukoliko Putnik otkaže putovanje, Organizator od ukupne cijene aranžmana zadržava:
– do 60 dana prije polaska 25% cijene aranžmana, a najmanje 300 EUR,
– 59 – 45 dana prije polaska 50% cijene aranžmana
– 44 – 0 dana prije polaska 100% cijene aranžmana,
– nakon polaska 100% cijene aranžmana,
ukoliko nije drugačije definirano u predugovornim informacijama.

3.9.b. U slučaju paket-aranžmana koji uključuju smještaj na plovilima, vrijedi sljedeća otkazna skala, ukoliko nije drugačije definirano u predugovornim informacijama:
– do 60 dana prije polaska 50% cijene aranžmana
– 59 – 0 dana prije polaska 100% cijene aranžmana,
– nakon polaska 100% cijene aranžmana.

3.10. Organizator može raskinuti ugovor o putovanju u paket-aranžmanu prije početka paket-aranžmana i Putniku u cijelosti vratiti sva plaćanja primljena za paket-aranžman, bez obveze naknade štete Putniku, ako organizatora u izvršenju ugovora spriječe izvanredne okolnosti koje se nisu mogle izbjeći. Ukoliko do tih okolnosti dođe, Organizator će Putnika putem e-pošte obavijestiti o raskidu ugovora bez nepotrebnog odgađanja prije početka paket-aranžmana.

3.11. Organizator će za svako putovanje u paket-aranžmanu koje se organizira za grupe naznačiti u predugovornim informacijama najmanji broj osoba potreban za ostvarivanje paket-aranžmana. Ukoliko taj broj ne bude dosegnut, organizator zadržava pravo raskida ugovora o putovanju u paket-aranžmanu prije početka paket-aranžmana, a o čemu će obavijestiti Putnika najkasnije dvadeset dana prije početka paket-aranžmana za putovanja koja traju više od šest dana, sedam dana prije početka paket-aranžmana za putovanja koja traju između dva i šest dana, i 48 sati prije početka paket-aranžmana za putovanja koja traju manje od dva dana, te najkasnije 6 sati prije početka dnevnih izleta.

3.12. Putnik može raskinuti ugovor bez plaćanja bilo kakve naknade za raskid ugovora prije početka paket-aranžmana u slučaju izvanrednih okolnosti, primjerice ako na odredištu postoje ozbiljni sigurnosni problemi koji bi mogli utjecati na paket-aranžman, ukoliko nije drugačije definirano u predugovornim informacijama.

3.13. Navedeni troškovi otkaza primjenjuju se i na promjene datuma polaska ili smještajnog objekta, odnosno tipa sobe/apartmana kao i na sve druge bitne promjene. Eventualna drugačija otkazna skala od navedene nalazi se u programu i predugovornim informacijama na koji se ta skala odnosi.
Ako Putnik koji otkaže putovanje nađe novog korisnika iste rezervacije, a koji ispunjava sve predviđene uvjete, Organizator zaračunava samo troškove uzrokovane zamjenom.
U slučaju da Putnik otkaže ili skrati putovanje zbog vremenskih uvjeta, Organizator će primijeniti gore navedenu skalu, a naknadne reklamacije neće uvažiti.

3.14. Organizator zadržava pravo promjene dana ili sata polaska zbog izmjena reda plovidbe ili vožnje ili nastupanja nepredviđenih okolnosti, kao i pravo izmjene pravca putovanja ukoliko se promjene uvjeti putovanja kao što su neki od sljedećih: promjena voznog reda, plovidbenog reda, sigurnosna situacija u zemlji, vremenske (ne)prilike i to bez isplate odštete.

3.15. Organizator zadržava pravo odbiti pružiti uslugu putniku u slučaju da procjeni da bi njegovo sudjelovanje u aktivnosti imalo znatan utjecaj na povećanje rizika od nezgode.
U tome slučaju putnik nema pravo na povrat uplaćene naknade, kao na ni sniženje cijene paket-aranžmana ili izleta zbog nesudjelovanja u ranije dogovorenoj aktivnosti.
Putnik u slučaju isključenja zbog procjene povišenog rizika sudjelovanja, nema pravo na odštetu.

3.16. Organizator ne naplaćuje trošak rezervacije.
U slučaju promjene rezervacije ili u slučaju odobrenog prijenosa paket-aranžmana na drugu osobu, Organizator naplaćuje naknadu za promjenu rezervacije u iznosu od 50EUR po rezervaciji.

3.17. Molimo da obratite pozornost na popuste za djecu, kao i na ostale pogodnosti koje su posebno prikazane u opisu dogovorenog aranžmana ili kao dio predugovornih informacija.

4. Obveze Organizatora
4.1. Za izvršenje usluga putovanja obuhvaćenih ugovorom o putovanju u paket-aranžmanu odgovoran je Organizator, bez obzira na to mora li te usluge izvršiti sam ili ih moraju izvršiti drugi pružatelji usluga putovanja.

4.2. Organizator je dužan Putniku pružiti sve ugovorene usluge za pojedini aranžman te dati odgovore zbog možebitnog neizvršenja usluga ili dijela usluga. Ako bilo koja od usluga putovanja nije izvršena u skladu s ugovorom o putovanju u paket-aranžmanu, Organizator će na zahtjev Putnika ispraviti tu nesukladnost, osim ako to nije moguće ili ako bi otklanjanje nesukladnosti prouzročilo nerazmjerne troškove uzimajući u obzir razmjer nesukladnosti i vrijednost usluga putovanja na koje nesukladnost utječe.

4.3. Organizator će sve navedene obveze iz svojih programa izvesti u potpunosti i na opisani način, osim u slučaju “više” sile ili promijenjenih okolnosti. Ako bude moguće, Organizator će u takvim slučajevima ponuditi zamjensko rješenje.

4.4 Ako organizator ne ispravi nesukladnost iz razloga koji su navedeni u točki 4.2. ovih Općih uvjeta, putnik ima pravo na sniženje cijene i naknadu štete sukladno odredbama ovih Općih uvjeta koji reguliraju pravo na sniženje cijene i naknadu štete.

4.5 Ako nakon početka paket-aranžmana značajne elemente paket-aranžmana nije moguće pružiti kako je dogovoreno, morati će biti ponuđeni alternativni aranžmani bez dodatnih troškova. Ako usluge nisu pružene u skladu s ugovorom i to znatno utječe na izvršenje paket-aranžmana, a Organizator ne ispravi nesukladnost, putnici mogu raskinuti ugovor o putovanju u paket-aranžmanu bez plaćanja naknade za raskid.

4.6 Putnici imaju pravo na sniženje cijene i/ili naknadu štete ako usluge putovanja ne budu izvršene ili ako budu izvršene na nepravilan način.

4.7. Ako organizator predloži alternativni putni aranžman čija je posljedica paket-aranžman niže kvalitete od one navedene u ugovoru o putovanju u paket-aranžmanu, organizator će putniku odobriti primjereno sniženje cijene.

4.8. Putnik ima pravo na primjereno sniženje cijene za svako razdoblje tijekom kojeg je postojala nesukladnost u vezi s ugovorenim putovanjem u paket-aranžmanu, osim ako organizator dokaže da se nesukladnost može pripisati putniku.

4.9 Putnik ima pravo, neovisno o sniženju cijene ili raskidu ugovora, zahtijevati od organizatora primjerenu naknadu za svaku štetu koju pretrpi kao rezultat bilo koje nesukladnosti, a organizator će putniku nadoknaditi tu štetu bez nepotrebnog odgađanja.

4.10. Organizator se oslobađa odgovornosti za štetu ako dokaže da se nesukladnost može pripisati putniku ili da se nesukladnost može pripisati trećoj osobi koja nije povezana s pružanjem usluga putovanja obuhvaćenih ugovorom o putovanju u paket-aranžmanu i da je nesukladnost nepredvidiva ili neizbježna ili da je do nesukladnosti došlo zbog izvanrednih okolnosti koje se nisu mogle izbjeći.

4.11. Organizator unaprijed ograničava iznos naknade štete za štete koje nisu posljedica tjelesne ozljede ili za štete koje organizator nije prouzročio namjerno ili nepažnjom na iznos u visini trostruke ukupne cijene paket-aranžmana.

4.12. Ukoliko se međunarodnim konvencijama koje obvezuju Europsku uniju ili zakonskim propisima koji se temelje na njima ograničuje opseg naknade štete koju je dužan platiti pružatelj usluge putovanja koja je dio paket-aranžmana ili ograničuju uvjeti pod kojima je on dužan tu štetu nadoknaditi, u tom slučaju iste se pretpostavke, ograničenja i isključenja na odgovarajući način primjenjuju na organizatora i on se u odnosu na putnika može pozivati na tu činjenicu.

4.13. Pravo putnika na naknadu štete ili sniženje cijene propisano Zakonom o pružanju usluga u turizmu i međunarodnim konvencijama ne utječe na prava putnika u skladu s Uredbom (EZ) br. 261/2004 Europskog parlamenta i Vijeća od 11. veljače 2004. o utvrđivanju općih pravila odštete i pomoći putnicima u slučaju uskraćenog ukrcaja i otkazivanja ili dužeg kašnjenja leta u polasku te o stavljanju izvan snage Uredbe (EEZ) br. 295/91; Uredbom (EZ) br. 1371/2007 Europskog parlamenta i Vijeća od 23. listopada 2007. o pravima i obvezama putnika u željezničkom prometu; Uredbom (EZ) br. 392/2009 Europskog parlamenta i Vijeća od 23. travnja 2009. o odgovornosti prijevoznika u prijevozu putnika morem u slučaju nesreća; Uredbom (EU) br. 1177/2010 Europskog parlamenta i Vijeća od 24. studenoga 2010. o pravima putnika kada putuju morem ili unutarnjim plovnim putovima i o izmjeni Uredbe (EZ) br. 2006/2004; Uredbom (EU) br. 181/2011 Europskog parlamenta i Vijeća od 16. veljače 2011. o pravima putnika u autobusnom prijevozu i izmjeni Uredbe (EZ) br. 2006/2004.

4.14.Putnik ima pravo podnijeti zahtjeve za sniženje cijene i/ili naknadu štete u skladu sa Zakonom o pružanju usluga u turizmu i u skladu s međunarodnim konvencijama i uredbama iz prethodne točke ovih Općih uvjeta.

4.15. Naknada štete ili sniženje cijene na koje putnik ima pravo u skladu sa Zakonom o pružanju usluga u turizmu i u skladu s međunarodnim konvencijama i uredbama iz točke 4.13. ovih Općih uvjeta oduzimaju se jedne od drugih kako bi se izbjegla prekomjerna odšteta i/ili prekomjerno sniženje cijene.

4.16. Pravo putnika da zahtijeva sniženje cijene temeljem odredaba Zakona o pružanju usluga u turizmu koje reguliraju pitanja izmjene ugovora o putovanju u paket-aranžmanu prije početka paket-aranžmana, izvršenja paket-aranžmana, te sniženja cijene i naknade štete zastarijeva u roku od dvije godine. Zastara počinje teći prvoga dana poslije dana na koji bi paket-aranžman prema ugovoru trebao završiti.

4.17. Organizator će pružiti primjerenu pomoć bez nepotrebnog odgađanja putniku u poteškoćama, a osobito u okolnostima kada zbog izvanrednih okolnosti koje se nisu mogle izbjeći nije moguće osigurati povratak putnika u skladu s ugovorom o putovanju u paket-aranžmanu. Ta se pomoć posebice odnosi na pružanje primjerenih informacija o zdravstvenim službama, lokalnim tijelima i konzularnoj pomoći i pomaganje putniku pri uspostavljanju daljinske komunikacije i pri pronalaženju alternativnih putnih aranžmana.

4.18. Ako je putnik poteškoću prouzročio namjerno ili nepažnjom, organizator će za pomoć iz prethodne točke ovih Općih uvjeta naplatiti naknadu koja neće biti viša od stvarnih troškova organizatora.

4.19. Organizator nije dužan pružati usluge van ovih Uputa i uvjeta. 

4.20. Organizator ne odgovara za eventualne pogreške u tisku.

5.Obveze Putnika
5.1.Putnik je dužan brinuti se da osobno ispuni uvjete predviđene propisima Republike Hrvatske i zemlje kroz koju ili u koju putuje te je dužan pridržavati se kućnog reda u hotelskim i drugim objektima i surađivati s predstavnikom organizatora i davateljima usluga.

5.2. Putnik je dužan na vrijeme prije putovanja ispuniti sve uvjete odredišne zemlje u vezi s putovnicama i vizama te zdravstvenim formalnostima naznačenima u predugovornim informacijama, a tijekom putovanja sve potrebne putne dokumente uključujući i odgovarajuće potvrde o ispunjavanju zdravstvenih formalnosti imati sa sobom i dati na uvid nadležnim službenicima.

5.3. Putnik sam odgovara za štetu koju prouzroči, a posebno za štetu koja je nastala kao posljedica nepoštivanja ugovora i ovih Uputa i uvjeta.

5.4. Posljedice i troškove štete koju je prouzročio, Putnik će snositi odmah na recepciji hotela, plovilu ili na drugom mjestu određenom od fizičke ili pravne osobe kojoj je štetu nanio.

5.5. U slučaju sudjelovanja u pustolovnim i sportskim aktivnostima, putnik je dužan dostaviti tražene informacije u fizičkoj spremi, te eventualnim zdravstvenim problemima.

5.6. Putnik je dužan, bez nepotrebnog odgađanja i vodeći računa o okolnostima, obavijestiti organizatora o svakoj nesukladnosti koju utvrdi tijekom ispunjenja usluge putovanja obuhvaćene ugovorom o putovanju u paket-aranžmanu

6. Kategorizacija i opis usluga
6.1.Ponuđeni smještajni kapaciteti u Organizatorovim programima opisani su prema službenoj kategorizaciji Republike Hrvatske važećoj u trenutku izdavanja programa.
Prehrana, komfor kao i druge usluge u ponudi hotela/apartmana pod nadzorom su mjesnih turističkih uprava.
Organizator ne preuzima odgovornost za usmenu ili pismenu informaciju koja nije u skladu s opisom usluga i objekata u objavljenim programima, a koja je dobivena od strane treće osobe.
Raspored soba/apartmana određuje recepcija u mjestu boravka. Ukoliko Putnik nije izričito ugovorio neku određenu sobu/apartman, prihvatit će bilo koju službeno registriranu smještajnu jedinicu za izdavanje u pojedinom smještajnom objektu definiranom u ponudi dogovorenog paket aranžmana.
Smještaj u sobi najčešće nije moguć prije 16 sati na dan početka korištenja usluge, a ista se najčešće mora napustiti do 10 sati na dan završetka korištenja usluga.
Dolaske iza 20 sati nužno je najaviti unaprijed, osim ako nije drugačije naznačeno.
Boravak kućnih ljubimaca dozvoljen je u pojedinačnim slučajevima uz obaveznu doplatu.

6.2. Organizator će za izvršenje usluga prijevoza u okviru paket-aranžmana koristiti prijevozna sredstva prijevoznika koji imaju odgovarajuće licencije sukladno posebnim propisima kojima se regulira pojedina vrsta prijevoza. Ukoliko u predugovornim informacijama izričito nije naznačeno drugačije, organizator će koristiti prijevozna sredstva u kojima su putničke kabine klimatizirane i s razglasom, a sjedala s mogućnošću naginjanja i najmanje jednim naslonom za ruke. Kod autobusnog prijevoza ukoliko u predugovornim informacijama nije izričito naznačeno drugačije, organizator zadržava mogućnost korištenja minibuseva, niskopodnih, visokopodnih i autobusa na kat, a pri čemu dio sjedala može biti okrenut suprotno od smjera vožnje.

6.3. Turističke usluge obuhvaćene paket-aranžmanom općenito nisu prikladne za osobe sa smanjenom pokretljivošću, osim ako u predugovornim informacijama izričito nije naznačeno drugačije. Na zahtjev putnika organizator će osigurati i preciznije informacije o prikladnosti putovanja ili odmora uzimajući u obzir potrebe putnika.

7. Devizni i carinski propisi
Putnici su dužni pridržavati se deviznih i carinskih propisa, kao i zakona i podzakonskih propisa Republike Hrvatske i drugih zemalja kroz koje prolaze i u kojima borave.
U slučaju nemogućnosti nastavka putovanja radi kršenja propisa od strane Putnika, sve nastale troškove snosi sam Putnik koji je prekršio propise.

8. Zdravstveni propisi
Za putovanja u neke zemlje potrebno je obaviti obvezna cijepljenja Putnika protiv nekih bolesti. Prilikom putovanja u takve zemlje Putnik je obvezan posjedovati potvrde i dokumente o cijepljenju.

9. Prtljaga
Putnik je dužan voditi brigu o svojim stvarima unesenima u kabinu vozila, te ih je prilikom svakog napuštanja istog dužan ponijeti sa sobom. U protivnom, Putnik sam snosi odgovornost za krađu, gubitak ili oštećenje stvari ostavljenih u kabini autobusa bez njegovog nadzora.

10. Reklamacije
10.1.Sukladno odredbama Zakona o pružanju usluga u turizmu putnik ima pravo podnošenja pisanih prigovora putem pošte na adresu Aktivni Odmor d.o.o., turistička agencija, J.Klovica, 21000 Split ili elektroničke pošte info@andadventure.com. O podnesenom pisanom prigovoru organizator će bez odgađanja potvrditi njegov primitak i u roku 15 dana od dana zaprimljenog prigovora u pisanom obliku odgovoriti na prigovor.

10.2. Sukladno posebnom zakonu o alternativnom rješavanju potrošačkih sporova dostupni mehanizmi za alternativno rješavanje potrošačkih sporova obuhvaćaju mogućnost pokretanja postupka alternativnog rješavanja potrošačkog spora pri ovlaštenom tijelu za alternativno rješavanje potrošačkih sporova kojim je organizator obuhvaćen i putem platforme za mrežno rješavanje potrošačkih sporova za usluge kupljene putem interneta.

10.3.Ovlašteno tijelo za alternativno rješavanje potrošačkih sporova kojim je organizator obuhvaćen jest Centar za mirenje pri Hrvatskoj gospodarskoj komori, Rooseveltov trg 2, 10000 Zagreb, https://www.hgk.hr/centar-za-mirenje/o-mirenju.

10.4. Za usluge koje su kupljene putem interneta putnik može svoju pritužbu uputiti ovlaštenom tijelu za alternativno rješavanje potrošačkih sporova koristeći platformu za mrežno rješavanje potrošačkih sporova koja je dostupna na sljedećoj adresi mrežne stranice https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=HR

11. Osiguranje za slučaj platne nemogućnosti ili stečaja organizatora putovanja
U skladu sa Zakonom o turističkoj djelatnosti, u slučaju platne nemogućnosti ili stečaja Organizatora, putnici zatečeni na putovanju, kao i osobe koje su uplatile akontacije za putovanje trebaju na najbrži način kontaktirati osiguravatelja navedenog na ugovoru o putovanju ili na drugom odgovarajućem dokumentu. 12. Zaštita osobnih podataka
Putnik osobne podatke daje dobrovoljno. Osobni podaci Putnika potrebni su u procesu realizacije tražene usluge. Isti će se koristiti i za daljnju međusobnu komunikaciju.
Organizator se obvezuje da neće osobne podatke Putnika iznijeti iz zemlje ili ih dati trećoj osobi, osim u svrhu realizacije tražene usluge.
Osobni podaci Putnika čuvat će se u bazi podataka, sukladno odluci Uprave o načinu prikupljanja, obrade i čuvanja osobnih podataka.
Putnik daje privolu da se njegovi osobni podaci mogu koristiti u svrhu marketinških akcija Organizatora.

13. Završne odredbe
Ove Upute i uvjeti sastavni su dio Ugovora kojeg Putnik sklapa s Organizatorom, odnosno s ovlaštenom putničkom agencijom u kojoj se prijavio za putovanje u organizaciji Organizatora. Moguća/predviđena odstupanja od ovih Uputa i uvjeta, moraju biti navedena uz tekst programa putovanja ili/i u predugovornim informacijama, ukoliko se radi o turoperatorima – inozemnim organizatorima putovanja. Potpisivanjem ugovora Putnik u cijelosti prihvaća program i ove Upute i uvjete. Izdavanjem ovih Uputa i uvjeta prestaju važiti sva ranije izdanja.
